Terms and conditions when using Aupairads.com

1. Background information

Aupairads.com is a website provided by C.B. Holding AB (556747-7020), Stockholm, Sweden (Aupairads.com) offering space for ads and tools for matching Clients and Candidates.

This agreement is between Aupairads.com and the Users, it does not regulate relationships between Users.

2. Definitions

In this agreement: “Candidate” means a person using the Service in order to find an au pair employment.
“Client” means a person representing a family who is using the Service in order to find an au pair.
"Content" means any data, text, pictures, files, links, software, or other materials posted by User via the Service.
“Service” means the au pair matching services provided or presented at the web site Aupairads.com and any other similar web site operated by Aupairads.com.
“User” means any registered member, i.e. a Client or a Candidate using the Service.

3. RULES & User’s obligations

User is responsible for all Content and for all activities which take place in relation to User’s account. Listed below are some, though not all, violations which may result in Aupairads.com terminating your account. You agree not to do any of the following:
(i) Harass, defame, threaten, embarrass or cause distress or discomfort upon anyone or any business or entity;
(ii) Post any Content that Aupairads.com may consider to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable;
(iii) Impersonate any person, including but not limited to, public figures and celebrities;
(iv) Post any untrue or incorrect information.
(v) Use the Service with commercial purposes.
(vi) Post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation; or
(vii) Intentionally or unintentionally violate any applicable local, state, national or international law while using or accessing the Service.
Minors (people under the age of 18) are not allowed to use the Service. By registering at our site, you confirm that you are at the age of 18 or older.
User agree to indemnify and hold Aupairads.com harmless from and against any breach by User of this agreement and any claim or demand brought against Aupairads.com by any third party arising out of User’s use of the Service.

4. Aupairads.com’s responsibility and obligations

Aupairads.com makes no recommendations about the Users or accepts responsibility of their conduct. Aupairads.com does not involve with any contracts or employment arrangements between the Users.
The final decision to agree on an au pair employment rests with the Users and Aupairads.com can give no warranty, representation or undertaking as to the suitability, honesty or capability of any Candidate or Client nor as to the completeness, truthfulness or accuracy of any information or statement or reference provided by the any Candidate or Client. Verification of all such information and references shall be the Users’ sole responsibility.
Aupairads.com shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation, whether direct, indirect or consequential, which may be suffered or incurred by User in relation to the use of the Service.

5.FEES

Candidates can register and use Aupairads.com free of charge.
Clients can register free of charge. To be able to create an ad and use the service fully, the Client has to pay a fee. The applicable fees and the validity periods (per single ad) can be found on Aupairads.com. The fees are non-refundable.
Aupairads.com reserves the right to change fees or use campaigns affecting prices without prior notification.

6. INTELLECTUAL PROPERTY and license

User agree not upload or transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party.
By including Content to your profile, you automatically grant (or warrant that the owner of such Content has expressly granted) Aupairads.com the royalty-free, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such Content. The rights granted to Aupairads.com are limited to use etc. in relation to the operation and marketing of the Service and can be terminated by User in writing with 90 days notice. Aupairads.com maintains the right to remove any Content that may violate any proprietary right of any party.

7. CONTENT

User must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. Aupairads.com shall not be responsible for any Content. Aupairads.com does not prescreen or monitor all Content, but Aupairads.com shall have the right, but not the responsibility, to remove Content which is deemed in Aupairads.com 's sole discretion harmful, offensive, or otherwise in violation of this agreement or any rules Aupairads.com has in place at the time, or for any reason whatsoever, at Aupairads.com 's sole discretion. Aupairads.com may elect at its sole discretion to monitor some, all, or no areas of the Service for adherence to this agreement.

8. Privacy and personal data

By using the Service and/or accepting this Agreement, the User give consent to Aupairads.com to process the Users personal data to the extent needed to provide the Service.
The User may revoke its consent which will cause the Service to terminate.
Aupairads.com will process the personal data in accordance with the Swedish Personal Data Act (Sw: personuppgiftslagen).

9. MISCELLANEOUS

Aupairads.com has the right to terminate any User account at any time.
No variation or alteration of these terms and conditions shall be valid unless approved in writing by the company.
Aupairads.com reserves the right to change this agreement without prior notification. By using the Service, User accepts the latest version of this agreement.
If any part of these conditions is held to be illegal, invalid or unenforceable in any respect such invalidity, illegality or unenforceable shall not prejudice the effect of the rest of these conditions to the extent that they are valid, legal and enforceable.
This Agreement will be governed by and construed in accordance with the laws of Sweden and the parties hereby submit to the exclusive jurisdiction of the Stockholm City Court (Sw. Stockholms tingsrätt) in respect of any dispute or matter arising out of or connected with this agreement.
